Terms of Service

These Terms of Service ("Terms") govern your access to and use of the FarmBuzz platform — including the website (farmbuzz.com), mobile applications, and all related services (collectively, the "Platform"). By creating an account or using FarmBuzz, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By registering, accessing, or using FarmBuzz, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Community Guidelines. These documents together form a legally binding agreement between you and FarmBuzz.

You must be at least 18 years of age to create an account and use FarmBuzz. By using the Platform, you represent that you are at least 18 years old.

2. Account Registration and Security

1. Accounts are created using a mobile phone number. One phone number may only be associated with one active account.
2. You set a 6-digit PIN at registration. You are solely responsible for keeping your PIN confidential and for all activity that occurs under your account.
3. Phone-number verification via SMS one-time code is required to create an account and to recover access.
4. You agree to provide accurate, current, and complete information at registration and to keep that information up to date.
5. Notify us immediately if you suspect unauthorized access through the Support page.
6. We may suspend or terminate accounts that violate these Terms or pose a security or trust risk to the community.

3. Acceptable Use

You agree to use FarmBuzz only for lawful purposes. You shall not:

1. Use the Platform for gambling, betting, or wagering of any kind. FarmBuzz is a community platform for serious keepers, breeders, growers, and hobbyists. It is not a gambling venue and is not affiliated with any gambling activity.
2. Post, share, or promote content related to wagering, betting odds, gambling tips, or coordination of wagering events.
3. Sell, offer for sale, or facilitate the sale of live animals through the FarmBuzz marketplace. Permitted listings are limited to supplies, feed, equipment, accessories, plants, and related non-live products.
4. Use the Platform to engage in activity that violates applicable law in your country of residence or the country where you transact — including animal welfare violations, fraud, harassment, defamation, or intellectual property infringement.
5. Attempt to gain unauthorized access to other accounts, our servers, or any part of the Platform infrastructure.
6. Use automated bots, scrapers, or other tools to access the Platform without our express written consent.
7. Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
8. Upload, transmit, or distribute malicious code, viruses, or other harmful material.
9. Interfere with or disrupt the Platform or its servers and networks.
10. Collect or harvest personal data of other users without their consent.

4. Marketplace Terms

When the FarmBuzz marketplace is available in your country:

1. Permitted items: supplies, feed, supplements, vitamins, equipment, accessories, hatching eggs (where lawful), seeds, plants, and other non-live-animal products relevant to your community. Live-animal sales are prohibited globally on the Platform.
2. Seller responsibilities: sellers are responsible for the accuracy of their listings, the quality of their products, and compliance with all laws and regulations that apply in their country and the buyer's country. Sellers must hold any required permits or licenses for the items they list.
3. Commission: FarmBuzz may charge a commission on marketplace transactions. Rates are disclosed before any listing is published.
4. Disputes: FarmBuzz provides a dispute-resolution mechanism for marketplace transactions. We may mediate but are not obligated to resolve disputes between buyers and sellers.
5. Prohibited listings: we may remove any listing that violates these Terms, our Community Guidelines, or applicable law.

5. Paid Memberships and In-App Purchases

FarmBuzz is free to download, and the community features — posting, messaging, records, and the communities themselves — are free to use. Taking part does not require a purchase. We offer one optional paid membership and a small number of optional one-time purchases. Inside the mobile apps these are sold through the Apple App Store on iOS and Google Play on Android; that store is the merchant of record and handles billing, receipts, and refunds.

1. FarmBuzz Annual Membership (auto-renewable subscription): a twelve-month supporter membership. It funds the people building and running the community. It does not unlock features — members and non-members have the same access to the Platform. The price is shown in your own currency on the Membership screen and on the store listing before you confirm; in the Philippines it is ₱299.00 per year as at the date above. Pricing is set per country and may change, and any change is shown to you before it takes effect.
2. Automatic renewal: the membership renews automatically for a further twelve months at the then-current price unless you cancel it at least 24 hours before the end of the current period. Payment is charged to your Apple ID or Google account when you confirm the purchase, and again on each renewal.
3. Introductory access: an account may receive a 7-day introductory period granted by FarmBuzz. It is not a store free trial, nothing is charged for it, and it ends by itself — it never enrols you in a subscription.
4. Referral codes: subscribing with a valid referral code grants a 14-month first term — twelve months plus two bonus months. Every term after the first is twelve months.
5. Cancelling: you can turn renewal off at any time. On iOS: Settings → your name → Subscriptions → FarmBuzz. On Android: Google Play → Payments and subscriptions → Subscriptions. Cancelling stops future charges; you keep your membership until the end of the period you have already paid for. Deleting the app does not cancel a subscription.
6. One-time purchases: some items, such as the Verified badge, are bought once and do not renew. Use Restore purchases on the Membership screen to recover them on a new device, signed in to the same store account you bought them with.
7. Refunds: refunds for App Store and Google Play purchases are handled by Apple and Google under their own policies, not by FarmBuzz. The unused part of a period already paid for is not refunded on cancellation. Where the law of your country gives you a stronger right of withdrawal or refund, that law applies.
8. Where purchases are unavailable: paid options are not offered in every country. Where they are not offered, no purchase control is shown and no charge is ever made.

For the iOS app, Apple's Licensed Application End User License Agreement also applies to your use of that app, and prevails over these Terms to the extent of any conflict.

6. AI Features Disclaimer

FarmBuzz offers in-app AI assistance that may provide general information, recommendations, and suggestions based on data analysis. By using AI features, you acknowledge:

1. AI output is general information only. It is not a substitute for professional veterinary, agricultural, medical, legal, or financial advice.
2. For health concerns about animals or plants under your care, always consult a licensed professional.
3. AI recommendations are based on statistical analysis and historical data. Outcomes vary and are not guaranteed.
4. We do not warrant the accuracy, completeness, or reliability of any AI-generated content.
5. You use AI features at your own risk. FarmBuzz is not liable for decisions made based on AI output.

7. Intellectual Property

1. The FarmBuzz name, logo, design, source code, and all associated intellectual property are owned by FarmBuzz. All rights reserved.
2. You retain ownership of content you create and post on FarmBuzz. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Platform for the purpose of operating and promoting FarmBuzz.
3. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Platform or any of its components without our written consent.
4. If you believe content on FarmBuzz infringes your copyright or other rights, contact us through the Support page with the specifics. We respond to valid takedown notices in line with applicable law.

8. Termination

1. By you: you may delete your account at any time through Settings → Account → Delete Account. Your data is handled in accordance with our Privacy Policy.
2. By us: we may suspend or terminate your account, with or without notice, for violations of these Terms, our Community Guidelines, or applicable law. We may also terminate accounts that have been inactive for more than 12 consecutive months.
3. Effect of termination: on termination, your right to access and use FarmBuzz ends immediately. Provisions that by their nature should survive — including intellectual property, limitation of liability, and dispute resolution — will survive.

9. Limitation of Liability

To the maximum extent permitted by the law that applies to you:

1. The Platform is provided "as is" and "as available," without warranties of any kind, whether express or implied.
2. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.
3. FarmBuzz is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
4. Our total liability to you for any claim arising from these Terms or your use of the Platform is limited to the amount you have paid us in the 12 months preceding the claim, or USD 100 equivalent, whichever is greater.
5. Nothing in these Terms limits liability that cannot be excluded under the law that applies to you (for example, certain consumer protection rights).

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which FarmBuzz operates the Platform for your country of residence, except where mandatory consumer protection law in your country applies and overrides this choice.

1. Informal resolution: before any formal complaint, contact us through the Support page. We will attempt to resolve the issue within 30 days.
2. Mediation: if informal resolution fails, both parties agree to attempt mediation through a mutually-agreed neutral mediator before pursuing litigation, where this is permitted by your local law.
3. Litigation: if mediation fails, disputes are resolved through the competent courts of the jurisdiction where you reside, unless the law that applies to you requires a different forum.
4. Class-action waiver: to the extent permitted by your local law, you agree to resolve disputes individually and waive participation in class actions. This waiver does not apply where it would violate mandatory law in your jurisdiction.

11. Compliance with Applicable Law

FarmBuzz operates in compliance with applicable laws in each market we serve. These include — but are not limited to — data protection law (GDPR in the EU, CCPA in California, LGPD in Brazil, RA 10173 in the Philippines), consumer protection law, animal welfare law, and electronic commerce regulations. Where you are subject to local law that is more protective than these Terms, that local law applies.

12. Changes to These Terms

We may modify these Terms from time to time. Material changes are communicated through the Platform and, where required, via SMS at least 15 days before they take effect. Your continued use of FarmBuzz after the effective date means you accept the updated Terms.
